Patient Terms & Conditions
1. About
Us
1.1. We
are TCC Aesthetics Ltd (company number 16754713) t/a The Coombe Clinic. We are an independent aesthetic clinic located
at Coombe Water, Coombe Bottom, West Monkton, Taunton, TA2 8RD. You can contact us at: info@thecoombeclinic.co.uk or 07308 424612. “We” “our” and “us” shall be
construed as references to The Coombe Clinic.
1.2. These
Patient Terms & Conditions (“Terms”) govern the provision of aesthetic
consultations, procedures and treatments (“Services”) provided by us to
individuals receiving our Services.
1.3. We
are committed to delivering safe, professional and evidence-based aesthetic
treatments, with patient wellbeing, informed consent and clinical excellence
being at the heart of our practice.
1.4. Please
read these Terms carefully before booking an appointment or proceeding with any
treatment.
1.5. By
booking an appointment with us, you agree to these Terms. Nothing in these Terms affects your statutory
rights.
1.6. These
Terms should be read alongside our Privacy Policy, Patient Terms &
Conditions Acknowledgement Form, and any treatment-specific information and
consent documentation provided to you.
1.7. These
Terms do not replace the requirement for appropriate consultation, clinical
assessment and informed consent to take place before any treatment.
2. Our
Services
2.1. We
provide non-surgical aesthetic services, which include the following:
· Facial
aesthetic consultations;
· Consultations
regarding prescription-only aesthetic treatment options;
· Dermal
filler treatments;
· Skin
rejuvenation procedures;
· Microneedling
and chemical peels; and
· Other
aesthetic procedures expressly offered by us.
3. Consultations
and Treatment Suitability
3.1. All
our aesthetic treatments are subject to an individual consultation and clinical
assessment by a suitably qualified practitioner.
3.2. The
consultation will consider your medical history, treatment objectives, relevant
risks and whether the proposed treatment is suitable for you.
3.3. We
reserve the right to decline, postpone, discontinue or modify any proposed treatment
where reasonably necessary for patient safety, clinical suitability, legal
compliance, professional obligations or where it is unlikely to meet the
patient’s expectations.
3.4. Where
we determine that treatment cannot safely proceed, we will explain our decision
and discuss any appropriate alternatives.
3.5. A
consultation does not guarantee that any treatment will be offered or
performed.
4. Medical
Information and Patient Responsibilities
4.1. Patients
are responsible for providing accurate and complete information regarding their
medical history, medications, allergies, previous aesthetic treatments and other
matters relevant to their treatment.
4.2. Patients
must inform their practitioner of any material changes to their health before
treatment.
4.3. Failure
to disclose relevant medical information may affect the safety and/or
suitability of treatment.
4.4. Treatment
recommendations are based on individual clinical assessment and professional
judgement.
4.5. Patients
should follow the pre-treatment and aftercare instructions provided by your
practitioner. Failure to follow
pre-treatment and aftercare instructions may affect treatment outcomes and/or
increase the risk of complications.
4.6. Patients
should contact us promptly if they experience any unexpected symptoms or
complications. However, patients who experience serious complications should
seek urgent medical attention where appropriate and contact the clinic as soon
as reasonably possible thereafter.
4.7. These responsibilities do not remove or reduce
our duty to exercise reasonable care and skill.
5. Informed
Consent
5.1. All
aesthetic treatments carry inherent risks, including the possibility of side
effects, adverse reactions and complications as further set out in clause 6
below.
5.2. Before
undergoing treatment, patients will be provided with relevant information
explaining the procedure, anticipated benefits, limitations, potential risks
and complications, and appropriate alternatives, including the option of no
treatment.
5.3. Patients
will have the opportunity to ask questions and consider the information
provided before deciding whether to proceed with any treatment.
5.4. By
giving informed consent, patients acknowledge that they have been informed of
and understand the material risks associated with their treatment, including
the possibility of unwanted side effects or complications, even when treatment
is performed correctly.
5.5. Patient
informed consent will be obtained and documented before any treatment is
undertaken.
5.6. Consent is voluntary and may be withdrawn at
any time before treatment.
6. Risks,
Side Effects and Complications
6.1. The
Coombe Clinic is committed to delivering treatments with reasonable care, skill
and clinical professionalism.
6.2. However,
aesthetic treatments are medical or cosmetic interventions and cannot be
considered entirely risk-free.
6.3. Potential side effects and complications may
include, but are not limited to:
· Redness,
swelling, bruising and tenderness;
· Temporary
discomfort or inflammation;
· Asymmetry,
unevenness or irregularities;
· Allergic
or inflammatory reactions;
· Infection
or delayed healing;
· Persistent
swelling or prolonged adverse reactions;
· Other
treatment-specific complications including rare but potentially serious
complications associated with particular procedures.
6.4. Individual
responses to treatment vary and cannot be predicted with certainty. A patient
may respond differently to the same treatment on different occasions due to
changes in their health, physiology or other contributing factors.
6.5. The
occurrence of a recognised side effect or complication does not indicate that
treatment has been performed incorrectly or negligently.
6.6. Where
a treatment has been performed with reasonable care and skill, the occurrence
of a recognised and appropriately disclosed side effect or complication does
not entitle the patient to a refund. This applies even where an adverse
reaction causes distress, inconvenience, a prolonged recovery period or
dissatisfaction with the treatment experience.
6.7. Patients
acknowledge that treatment fees reflect the professional service, clinical
expertise, products and procedures provided, rather than a guarantee of a
particular aesthetic outcome or an entirely complication-free experience.
6.8. All concerns will be assessed individually,
and appropriate clinical follow-up will be offered where necessary.
7. Treatment
Results and Expectations
7.1. The
effects and duration of aesthetic treatments vary depending on: (a) individual
characteristics such as age, anatomy, skin condition, lifestyle, metabolism and
individual biological response; (b) the treatment undertaken; and (c) other
relevant factors.
7.2. While
we will provide reasonable information regarding anticipated results, treatment
limitations and expected recovery, no specific aesthetic result, degree of
improvement or duration of effect can be guaranteed.
7.3. Some
treatments may require further treatments or ongoing maintenance to achieve or
sustain the desired outcome. Additional
treatments and associated charges will be discussed and agreed in advance.
7.4. This
clause does not exclude responsibility for treatment that fails to meet
applicable industry and legal standards, including the requirement to exercise
reasonable care and skill.
7.5. Dissatisfaction
with an aesthetic result does not entitle a patient to a refund where treatment
has been performed appropriately and in accordance with the agreed treatment
plan.
8. Reviews,
Complications and Corrective Treatment
8.1. Patient
safety remains our highest priority.
8.2. Where
clinically appropriate, we may recommend a follow-up appointment to assess
treatment outcomes, healing and patient concerns.
8.3. Where
a patient experiences a suspected adverse reaction or complication, that
patient should contact us promptly. Clinical concerns will be considered
individually, with patient wellbeing and safety remaining central to all
decisions.
8.4. The
Coombe Clinic will provide appropriate clinical assessment to determine
appropriate next steps which may include further review, advice, referral or
corrective treatment within the scope of its professional competence.
8.5. Additional
treatment, corrective procedures or top-ups are not included in the original
treatment fee unless expressly stated.
8.6. Where
additional treatment is requested solely for aesthetic preference, we will
explain any additional cost before proceeding and obtaining informed consent.
8.7. Where
a problem arises because we have failed to exercise reasonable care and skill,
your statutory rights and legal remedies will apply.
8.8. Where
urgent medical attention is needed, you should seek appropriate medical
assistance without delay.
9. Age
Restrictions
9.1. Patients
must meet the applicable minimum legal age requirements for their proposed
treatment.
9.2. In
England, cosmetic filler injections must not be administered to individuals under
18, except where a statutory medical exception applies.
9.3. We
may require photographic identification to verify a patient’s age before
confirming an appointment or before treatment.
9.4. We will not
provide treatments to anyone who does not meet the relevant legal or clinical
eligibility requirements.
10. Photographs and Patient Records
10.1. We may take
clinical photographs where appropriate for assessment, treatment planning,
clinical records and monitoring treatment outcomes.
10.2. Clinical
images will be handled securely in accordance with our Privacy Policy and
applicable data protection legislation.
10.3. We
will not use identifiable patient images for advertising, social media or
promotional purposes without obtaining appropriate separate patient consent.
10.4. Refusing consent to marketing use of photographs will not
affect your ability to receive treatment.
11. Personal Data and Confidentiality
11.1. We
collect and process personal information, including relevant health information
to assess treatment suitability, provide treatments, maintain clinical records
and fulfil our legal obligations.
11.2. We
will process your personal information in accordance with applicable data
protection legislation including UK GDPR and Data Protection Act 2018.
11.3. Further
information about how we use, collect, store and share personal data is
available in our Privacy Policy.
11.4. We
will maintain patient confidentiality except
where disclosure is required by law.
12. Appointments, Deposits and Cancellations
Appointments
12.1. Appointments
may be booked through our website, by telephone or in person.
12.2. Appointments
will be confirmed once we have accepted your booking request.
12.3. Please
arrive promptly for your appointment. If
you arrive late, we may need to shorten, reschedule or cancel your appointment
where there is insufficient time to carry out the treatment safely.
12.4. We
will explain any charges before confirming changes to an appointment.
Deposits
12.5. A
deposit may be required to secure an appointment. The amount will be confirmed
at the time of booking and will ordinarily be deducted from the total treatment
cost.
12.6. All
prices will be clearly communicated before treatment and will include
applicable taxes.
12.7. The
outstanding balance is payable immediately following treatment, unless
otherwise agreed in writing.
12.8. Where
a treatment plan changes following consultation, we will explain any
corresponding price change and obtain your agreement before proceeding.
12.9. Deposit
and advance payments will be handled in accordance with applicable consumer
protection legislation and the cancellation provisions below.
Cancellations
12.10. We
kindly request a minimum of 48 hours’ notice if you wish to cancel or
reschedule your appointment.
12.11. Where
sufficient notice is provided, we will offer to transfer your deposit to a
rearranged appointment date or refund it, subject to any applicable and clearly
agreed charges.
12.12. Where
you cancel without required notice or fail to attend, we may retain a
reasonable amount from your deposit to reflect losses arising from the
cancellation that we cannot reasonably avoid.
12.13. Any
cancellation charge will be proportionate and will not exceed our reasonable
net loss. We will take reasonable steps
to minimise that loss, including attempting to reallocate the appointment where
practicable.
12.14. Where
we cancel an appointment, we will offer a suitable alternative date or a refund
of payments relating to the Services not provided.
12.15. We
understand that unforeseen circumstances can arise and patients may not be able
to provide us with sufficient cancellation notice. In cases of genuine
emergencies or exceptional circumstances, The Coombe Clinic may, at its
discretion, allow a deposit to be transferred to a future appointment.
13.Consumer
Cancellation Rights
13.1. Depending
on the nature of the Services and how the contract is entered into, patients may
have statutory cancellation rights, including rights under the Consumer
Contracts (Information, Cancellation and Additional Charges Regulations 2013).
13.2. Where
those regulations apply to a distance or off-premises service contract,
patients will generally have fourteen (14) days from the day after entering
into the contract to cancel without giving a reason.
13.3. If
a patient expressly requests that Services begin during an applicable statutory
cancellation period, we will explain the consequences of that request and
obtain necessary agreement or acknowledgement before providing the Services.
13.4. Where
a patient lawfully exercises a statutory cancellation right, we will provide
any refund due in accordance with the applicable legislation.
13.5. This
section does not create or restrict your statutory rights where a particular
treatment or contract is excluded from the relevant regulations.
14. Treatment Courses and Packages
14.1. Some
treatments are offered as courses or packages involving multiple appointments.
14.2. The
recommended number of sessions, treatment intervals and anticipated benefits
will be explained before purchase.
14.3. Where
a patient chooses to discontinue a course, any refund for unused sessions will
be assessed in accordance with the agreed package terms and applicable consumer
legislation.
14.4. Where
treatment must be discontinued for clinical reasons, the clinic will review the
circumstances and any unused treatment entitlement fairly.
15. Complaints and Concerns
15.1. At
The Coombe Clinic, we aim to deliver safe, professional services and welcome
feedback from patients.
15.2. If
you are dissatisfied with any aspect of our Services, please contact Polly
Kirkness at info@thecoombeclinic.co.uk.
15.3. We
will acknowledge your complaint within three (3) working days and aim to
provide a substantive response within ten (10) working days, where reasonably
practicable.
15.4. Where
a complaint requires further clinical investigation, we will keep you informed
of progress and explain any necessary extension to the response timeframe.
15.5. We
will not prevent or discourage you from raising any concerns with an
appropriate professional regulatory or other relevant authority.
16. Limitation of Liability
16.1. The
Coombe Clinic shall exercise reasonable care and skill in providing its
Services in accordance with applicable law and relevant professional standards.
16.2. Nothing
in these Terms excludes or restricts liability for: (a) death, personal injury
caused by negligence; (b) fraud or fraudulent misrepresentation; (c) breach of
any statutory rights or obligations which cannot lawfully be excluded or
restricted, including those under the Consumer Rights Act 2015 and the right to
receive services performed with reasonable care and skill; or (d) any other
liability which cannot lawfully be excluded or restricted.
16.3. Subject
to clause 16.1 and 16.2, we are only responsible for foreseeable loss or damage
that is caused by our failure to keep these Terms.
16.4. The
Coombe Clinic is not responsible for: (a) any unforeseeable losses, or any
other loss or damage you may suffer which is not an obvious consequence of our
failure; or (b) where the failure is due to circumstances that were beyond our
reasonable control; or (c) any indirect, special or consequential losses you
may suffer, including any loss of profit, loss of income, loss of opportunity,
loss of contract or goodwill.
16.5. The
Coombe Clinic shall remain responsible for the acts and omissions of its
employees, practitioners, agents and subcontractors to the extent required by
applicable law.
16.6. Nothing
in these Terms excludes or restricts your statutory rights under the Consumer
Rights Act 2015 or any other applicable consumer protection legislation.
17.Changes
to these Terms
17.1. We
may update these Terms from time to time to reflect changes in legislation,
clinical practice or our business operations.
17.2. The
version made available to you when your booking is accepted will ordinarily
apply to that booking, unless we agree otherwise or a change is required by
law.
18.Third
Party Rights
18.1. A
person who is not a party to the contract between you and The Coombe Clinic
shall have no right to enforce any of its terms under the Contracts (Rights of
Third Parties) Act 1999.
18.2. This
clause does not affect any right or remedy available to a third party otherwise
than under that Act.
19.Waiver
19.1. If
either you or The Coombe Clinic delays or fails to exercise any right or remedy
under these Terms, this shall not constitute a waiver of that right or remedy
or prevent its subsequent exercise.
19.2. A
waiver of any right or remedy in relation to a particular breach shall not
constitute a waiver of any right or remedy in relation to any subsequent
breach.
19.3. Nothing
in this clause limits or excludes any statutory rights or remedies available to
you under applicable consumer protection legislation.
20.Governing
Law
20.1. These
Terms are governed by and construed in accordance with the laws of England and
Wales and any disputes that arise in relation to these Terms will be dealt with
by the English courts. Your legal rights are not affected.
